The Boyd Circuit Court Master Commissioner asks that you include him in the e-filing of the Motion and proposed Judgment and Order of Sale at rhall@boydcountykymastercommissioner.com when your e-file your documents in the Kentucky E-Courts E-filing System.
Most Orders referring foreclosure actions to the Commissioner for sales are entered by the Court on Fridays, but if the Commissioner is not included on the Ky E-Courts filing system to receive an e-mailed copy when entered by the Clerk, the Master Commissioner will not receive his copy of said Order until the next week - make sure the Master Commissioner is at least included on the certificate of service of the motion and proposed order documents. Please allow seven to ten business days for us to publish the information on this website and e-file a Notice of Sale. **Attention Attorneys: If a newly referred action has not been published after ten business days from the entry date of the Order of Sale, and you have not received an e-filed copy of our Notice of Sale, it may be possible that we did not receive our copy of the Order of Sale from the Boyd Circuit Court Clerk's Office. If you received your copy of the Order of Sale, please contact us to see if we need you to forward a copy to this office. Also, please note that we will not schedule a sale date until the Clerk sends us a copy of their receipt indicating that you have paid the $200.00 AOC Judicial Sale Fee to the Clerk at the time you filed your Motion for Order of Sale. This includes Motions to Reschedule Sale. It is also necessary that you forward a Form AOC-141S or AOC-141SP along with your Motion and the Judicial Sale Fee. We need this document to schedule a sale as well. Further, we ask that the legal descriptions that you attach to the Orders of Sale be legible without a doubt as to any numeral or letter and that you furnish a true full and current last source of title, along with the property address and map/parcel ID number that has been verified with the Boyd County Property Valuation Office. Concerning cancellations, if there is a pending Order of Sale, the Commissioner will proceed with scheduling and conducting the sale unless he receives an Order directing him otherwise, or unless the Order of Sale allows for canceling a sale upon the faxed written request of the Plaintiff or party who moved for the sale no later than 3:00 p.m. the day immediately prior to the sale date. Our sales will be scheduled on Friday mornings beginning at the hour of 11:00 a.m., and running every five (5) minutes until finished, so we must have faxed bids and cancellations by 3:00 p.m. on the Thursday afternoon immediately preceding the Friday sale date.
**We do accept one-time faxed bids, but we must receive your faxed bids and requests for cancellation by 3:00 p.m. on the Thursday immediately preceding the sale date. We will no longer take bids and cancellations on the date of sale unless you appear at the sale with a Court Order that was just entered that morning.
The Boyd County Master Commissioner prepares the Notice of Sale, Advertisement, Report of Sale, Letter of Costs and Master Commissioner's Deed. The Notice of Sale and Report of Sale are now e-filed with the Kentucky E-Courts E-Filing System for the Clerk to enter/certify copies to the parties. The Report of Sale will be filed no later than three (3) business days after the date of sale. If you see on this website that our Report of Sale has been filed, and you do not receive your copy within a reasonable amount of time, then you will need to contact the Clerk's Office for a copy, not the Commissioner. Prior to the sale date, the Commissioner e-files the Appraisals and you will obtain our copy in by e-mail from the Court. Also, we publish the appraised value of each property on this website prior to our e-filing the Appraisal document. The Master Commissioner will forward the Letter of Costs directly to the Attorney for foreclosing party by fax and/or USPS upon his completion of the same. The Master Commissioner will publish on this website the date on which the Letter of Costs has been forwarded, and the means - mailed, faxed, or both. Please note that the Master Commissioner cannot prepare the Report of Sale or a Letter of Costs until he has received the Affidavits from the Newspaper, which is the proof that the sale was advertised and the invoice for the advertisement. Per Boyd Circuit Court General Order (see the "More" tab above to view Orders), we will publish our advertisements no less than two times. When running the advertisement twice, we will publish the first run on a Friday that is 21 days prior to the sale date (first possible notice) and the second run on a Friday that is 7 days prior to the sale date (last possible notice), the same being in accordance with statute.
After the Master Commissioner has forwarded his Letter of Costs, and after the Report of Sale has laid the 10-day period for exceptions/objections, the Commissioner requests that the Attorney for foreclosing party draft and e-file with the Boyd Circuit Court Clerk the Motion and proposed Order Confirming Report of Sale and Directing Delivery of Deed and Distribution of Proceeds. When e-filing your motion and proposed Order, please include the Master Commissioner at rhall@boydcountykymastercommissioner.com so that he will receive a copy. It is necessary that you include the itemized fees, expenses and costs of the Commissioner on the proposed Order and include the Master Commissioner on the certification page of said Motion AND proposed Order in order for the Master Commissioner to know when to prepare the Deed and to know when the Order was signed by the Judge. It is also necessary to include the purchaser's name and address and tax bill mailing address in the proposed Order. Please note that the Attorney for foreclosing party must also furnish the Master Commissioner or Court with a statement that there are no unpaid County and City delinquent tax liens, nor assignments of any such liens against the property at the time of confirmation of sale. This statement may be incorporated in said Motion/proposed Order or it may be forwarded by way of correspondence or fax transmission to the Commissioner. Upon receipt of said statement, the monies for costs/third party sale proceeds, and the signed and entered Order Confirming Report of Sale and Directing Delivery of Deed and Distribution of Proceeds that itemizes the Commissioner's fees and costs, then the Commissioner will forward the deed/remaining sale proceeds directly to the Attorney for foreclosing party.
If the Master Commissioner's Deed forwarded to Attorney for foreclosing party upon entry of Order of Delivery of Deed is found to be incorrect prior to recording, and the Attorney will be asking for a revised substitute deed to replace it, the Commissioner must have the incorrect deed returned to him prior to preparing a new deed. If Attorney is asking for a substitute deed due to the fact that the original deed is lost, then Attorney's motion/proposed Order must state that the original was lost. If Attorney is asking for a Deed of Correction, then Attorney's motion/proposed Order must state the Deed Book and Page numbers of the where the incorrect deed has been recorded.
